Voluntary Disclosure - Wayward Americans
There are many US citizens living outside of the US. Some were born in the US but have lived many years in another country, while others may have been born in another country but to US citizen parent(s). While many of these individuals have been filing and paying their taxes in the country in which they live, they may have been unaware of their continued requirement (or of any requirement at all) to file US tax returns and information forms.
Voluntary disclosure is the way these individuals can get back into compliance before they are “found” by the IRS.
FACTA (Foreign Account Compliance Tax Act) took effect July 1, 2014. One of the effects of this piece of legislation is that foreign financial institutions may be forced to report the names of their US citizen account holders to the IRS. This may begin a chain of events where a non-compliant US taxpayer finds they are unable to avail themselves of the various voluntary disclosure programs leaving them subject to horrendous penalties.
Non-compliant US taxpayers should give very serious consideration to getting back into the US tax system as soon as possible.
